Section 1 — What do we do with your information?

When you purchase something from our store, as part of the buying and selling process, we collect the personal information you give us such as your name, address, email address, and — where you provide it — your phone number.

When you browse our store, we also automatically receive your computer's internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system.

Email and SMS marketing (if applicable): With your permission, we may send you emails and/or text messages about our store, new products, and other updates. We use Klaviyo and Attentive to manage our email marketing and Postscript to manage our SMS marketing. You can unsubscribe from email at any time using the link in any message, and from SMS by replying STOP. Message and data rates may apply to text messages.

Section 2 — Consent

How do you get my consent?

When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery, or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only.

If we ask for your personal information for a secondary reason, like marketing, we will either ask you directly for your expressed consent, or provide you with an opportunity to say no.

When you opt in to SMS marketing, you consent to receive recurring automated marketing text messages at the phone number you provide. Consent to receive marketing texts is not a condition of any purchase. Reply STOP to opt out at any time, or HELP for assistance.

How do I withdraw my consent?

Section 3 — Disclosure

We may disclose your personal information if we are required by law to do so or if you violate our Terms of Service.

Section 4 — Shopify

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you. Your data is stored through Shopify's data storage, databases and the general Shopify application. They store your data on a secure server behind a firewall.

Payment:

If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.

All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

Section 5 — Third-Party Services

In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.

However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions. For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers.

In particular, remember that certain providers may be located in or have facilities that are located in a different jurisdiction than either you or us. So if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.

Once you leave our store's website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website's Terms of Service.

Email and SMS marketing providers (Klaviyo, Attentive, Postscript)

We share the contact information you provide — such as your email address and phone number — with our marketing service providers so they can deliver our communications to you on our behalf. We use Klaviyo and Attentive for email marketing and Postscript for SMS marketing. These providers process your information in accordance with their own privacy policies, and only as needed to provide their services to us.

Wishlist & back-in-stock alerts (Swym)
We use Swym to power wishlist and back-in-stock notification features on our store. When you save items to a wishlist or request a back-in-stock alert, Swym processes the information needed to provide those features — such as your email address (where you provide it) and the products you've interacted with — and sends any alerts you've requested. Swym processes this information in accordance with its own privacy policy.

Shoppable social content (Foursixty)
We use Foursixty to display shoppable social media and user-generated content galleries on our store. Foursixty may collect information about how visitors interact with these galleries, such as clicks and engagement, to provide and measure that feature. Where we feature user-generated content, Foursixty also collects and processes the associated social media content, username, and related post information in order to display it and manage usage rights. Foursixty processes this information in accordance with its own privacy policy.

EU Withdrawal Requests (Revoq)

If you exercise your EU right of withdrawal, we use Revoq, a third-party withdrawal-management service, to receive and process your request. When you submit a withdrawal, Revoq collects the information needed to identify and handle it — such as your name, email address, and order details — and sends you a confirmation by email. Revoq is operated in Germany and stores data within the European Union. We recommend reviewing Revoq's own privacy policy to understand how it handles your information.

When you visit our website, log in, register or open an email, cookies, ad beacons, and similar technologies may be used by our online data partners or vendors to associate these activities with information they or others have about you, including your email address. We (or service providers on our behalf) may then send communications and marketing to these email addresses. You may opt out of receiving this advertising by visiting https://app.retention.com/optout.

Links: When you click on links on our store, they may direct you away from our site. We are not responsible for the privacy practices of other sites and encourage you to read their privacy statements.

Analytics: Our store uses Google Analytics to help us learn about who visits our site and what pages are being looked at.

Section 6 — Security

To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.

If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with AES-256 encryption. Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.

Section 7 — Cookies

The Lucy & Co. website uses cookies, tracking pixels and related technologies. Cookies are small data files that are served by our platform and stored on your device. Our site uses cookies dropped by us or third parties for a variety of purposes including to operate and personalize the website. Cookies may also be used to track how you use the site to target ads to you on other websites.

Cookie consent: If you visit our store from the European Union, European Economic Area, or United Kingdom, we ask for your consent before placing non-essential cookies (such as analytics and advertising cookies). You can accept, decline, or manage your preferences through our cookie banner.

Section 8 - Age of Consent

By using this site, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

Your Privacy Rights — European Union, EEA & United Kingdom (GDPR)

This section applies to individuals in the European Union, the European Economic Area, and the United Kingdom.

Legal bases for processing. We process your personal information on the following bases: performance of a contract (to fulfill your orders); your consent (for email/SMS marketing and non-essential cookies); our legitimate interests (to secure and improve our store, prevent fraud, and understand how our site is used); and compliance with legal obligations.

Your rights. Subject to applicable law, you have the right to access, correct, update, or request deletion of your personal information; to object to or request restriction of processing; to request portability of your data; and to withdraw consent at any time where processing is based on consent. International transfers. We are based in the United States, and your information may be transferred to and processed in the United States and other countries where we or our service providers operate. Where we transfer personal data out of the EEA, UK, or Switzerland to a country that has not received an adequacy decision, we rely on appropriate safeguards, which — depending on the provider — include the European Commission's Standard Contractual Clauses (together with the UK International Data Transfer Addendum and Swiss equivalent where applicable) and/or the EU-US Data Privacy Framework.

Data retention. We retain personal information only as long as necessary for the purposes described in this policy, including to satisfy legal, accounting, or reporting requirements. 

Right of withdrawal. If you are an EU consumer, you have a statutory right to withdraw from your purchase within 14 days. Details and the withdrawal function are available on our Returns & Exchanges web page. Requests are processed as described under "EU Withdrawal Requests (Revoq)" above.

Complaints. You have the right to lodge a complaint with your local data protection supervisory authority.

California Privacy Rights (CCPA / CPRA)

This section applies to California residents.

Categories of personal information we collect. Identifiers (such as name, email address, phone number, IP address); commercial information (such as products purchased); internet or other electronic network activity (such as browsing and interaction with our site and emails); and geolocation data (general, from IP). We collect this for order fulfillment, customer service, marketing, analytics, and advertising.

Sale or sharing of personal information. We do not sell your personal information for money. However, our use of advertising and analytics cookies/pixels (for example, Meta, TikTok, and Google, etc…) may constitute "sharing" of personal information for cross-context behavioral advertising under the CPRA. If you’d like to opt out you can do so upon website load by clicking “Decline” on the Cookie Consent banner.

The consent form content: We and our partners, including Shopify, use cookies and other technologies to personalize your experience, show you ads, and perform analytics, and we will not use cookies or other technologies for these purposes unless you accept them. Learn more in our Privacy Policy

Your rights. California residents have the right to know/access the personal information we collect, to request deletion, to request correction, to opt out of the sale or sharing of personal information, to limit the use of sensitive personal information, and not to be discriminated against for exercising these rights.

Section 9 — Changes to This Privacy Policy

We reserve the right to modify this privacy policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website. If we make material changes to this policy, we will notify you here that it has been updated, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it.

If our store is acquired or merged with another company, your information may be transferred to the new owners so that we may continue to sell products to you.
